In most cases the law and the information on this website applies equally to gay and lesbian couples and terms marriage and civil partnership and divorce and dissolution of civil partnership will be interchangeable.
Civil partnership has been available to gay and lesbian couples since December 2005 and marriage has been available since March 2014.
Almost all advice that relates to divorce/dissolution, financial arrangements and arrangements for children but there are some issues and some differences of which our LGBT clients should be aware.
Same Sex and Transgender Divorce:
The law and the Matrimonial Causes Act 1973, as amended by the Marriage (Same sex couples) Act 2013, which adds Section 1vi to the MCA, provides that only sex between people of the opposite gender can be recognised as adultery. For this purpose, the sex of a transgender person will be the gender assigned at birth until and unless they have a gender recognition certificate.
